User Agreement & Terms of Use

This Agreement sets forth the terms and conditions of your use of the accompanying Community Media Workshop’s online version of “Getting On Air, Online & Into Print”

1. LICENSE GRANT. Community Media Workshop grants to you (Licensee) a non-exclusive non-transferable license to use the online version of “Getting On Air, Online & Into Print” in the manner described below under “Scope of Grant.”

2. CONDITION OF LICENSE. The above license is granted to Licensee only if and so long as Licensee agrees to conduct all activities hereunder in conjunction with a Community Media Relations Subscription.

3. WARRANTY. COMMUNITY MEDIA WORKSHOP DOES NOT WARRANT THE ONLINE VERSION OF GETTING ON AIR AND INTO PRINT AND YOU ACCEPT IT “AS IS.” COMMUNITY MEDIA WORKSHOP HEREBY DISCLAIMS ANY OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. HOWEVER, BECAUSE CUSTOMER SERVICES IS A PRIMARY VALUE OF COMMUNITY MEDIA WORKSHOP WHICH TAKES PRIDE IN ITS PRODUCT, CALL WORKSHOP OFFICES TO DISCUSS POSSIBLE PRODUCT DEFECTS.

4. SCOPE OF LICENSE GRANT. 4.1. You may:

4.1.1. Use the Software on any web-enabled computer with a browser. Community Media Workshop is not responsible for any damage done while allowing other users access to your account and account information and may result in the immediate expiration of your account to protect Community Media Workshop from harm, damage or vulnerability of private information.

4.2. You may not: 4.2.1. Permit other organizations or individuals outside your organization to use your account information to access our online product (Software); 4.2.2. Modify, translate, reverse engineer, decompile, disassemble, or create derivative works based on the

Software; 4.2.3. Copy the Software other than as specified above; 4.2.4. Rent, lease, grant a security interest in, or otherwise transfer rights to the Software; or 4.2.5. Remove any proprietary notices or labels on the Software.

5. TITLE. Title, ownership rights, and intellectual property rights in the Software shall remain in Community Media Workshop. The Software is protected by copyright and other intellectual property laws and by international treaties.

6. TERMINATION. This Agreement and the license granted hereunder will terminate automatically if you fail to comply with the limitations described herein. Upon termination, you must destroy all copies of the Software and Documentation.

7. MISCELLANEOUS. This Agreement represents the complete agreement concerning the license granted hereunder and may be amended only by a writing executed by both parties. If any provision of this Agreement is held to be unenforceable, such provision shall be reformed only to the extent necessary to make it enforceable. This Agreement shall be governed by laws set forth by the state of Illinois, excluding conflict of law provisions (except to the extent applicable law, if any, provides otherwise).

8. ACCEPTANCE OF AGREEMENT: Upon subscribing to the Software, You agree to, and will be deemed to, have signed the Agreement, as if you signed a written agreement in hard copy. You will from that moment enjoy the benefits of the license described herein and will be subject to its restrictions.
